Monday, October 24th, the Department of Homeland Security sent the final AC21 Regulation, titled “Retention of EB-1, EB-2, and EB-3 Immigrant Workers and Program Improvements Affecting High-Skilled Nonimmigrant Workers,” to the Office of Management and Budget (OMB) for review. It could take OMB up to 90 days to review and publish the final regulation.

We do not yet know the exact content of this final regulation but the proposed regulation addressed a variety of vexing issues facing today’s employment-based immigrants. This regulation was also a key part of President Obama’s November 2014 immigration reform priorities. SPS Immigration will post highlights of the final regulation as soon as it is published.
