Today USCIS issued final guidance on when an Employer must file an amended H-1B Petition before moving an H-1B Employee to a new worksite in a geographic area not previously covered by the Labor Condition Application (LCA), including specific timeframes for compliance. USCIS’ guidance is a result of Matter of Simeio Solutions, 26 I&N Dec. 542 (AAO 2015), a precedent AAO decision that held that H-1B Employers are required to file an amended or new H-1B petition before placing an H-1B employee at a new worksite not covered by an existing, approved H-1B petition.
