USCIS announced that it received over 236,000 H-1B Cap Petitions which exceeds the statutory H-1B cap for fiscal year (FY) 2017. This is 3,000 more H-1B Cap Petitions than USCIS received last year.
On April 9th, USCIS conducted a computer-generated lottery and has started sending out receipt notices for cases filed under premium processing. USCIS will begin processing cases filed under premium processing no later than May 16th, 2016. We expect that USCIS will start generating receipt notices for H-1B Petitions filed under the standard processing times after it concludes sending receipt notices for cases filed under premium processing.
Employers and Employees who are exempt from the H-1B Cap remain eligible to file H-1B Petitions. Please contact SPS Immigration if you have questions regarding whether your case is exempt from the H-1B Cap.
